Terms of Service

These Terms of Service (“Terms”) govern your use of Efata’s website, account, editors, and related tools (“Service”). By creating an account or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

Efata provides AI-assisted creative tools, including design generation and editing, image tools, carousels, presentations, newsletters, animation and video, Content Planner, Brand Kit, Moodboards, and stock-photo search. Features may change, be limited, or become unavailable as the Service develops.

The Service helps you plan and create content. You are responsible for reviewing your work and for publishing or distributing it through any external platform you choose.

You must be at least 13 years old to use Efata. If you are 13 through 17, you may use the Service only with permission and supervision from a parent or legal guardian. Your parent or guardian must review and agree to these Terms and the Privacy Policy.

You must provide a valid email address, keep your sign-in details secure, and be responsible for activity under your account. Contact us promptly if you believe someone has accessed your account without permission.

You keep the rights you hold in prompts, files, images, text, and other materials you submit (“Inputs”), as well as any rights you may hold in resulting work (“Outputs”). Those rights remain subject to applicable law, third-party rights, and the terms of any provider or asset used to create the work.

You confirm that you have the rights and permissions needed to submit your Inputs and to ask Efata to process them. You grant Efata a limited permission to host, copy, display, transmit, and process Inputs and Outputs only as needed to provide, secure, and support the features you use. This permission does not transfer ownership of your content to Efata.

AI-generated or AI-assisted work can be inaccurate, incomplete, similar to work produced for others, or unsuitable for your intended use. Review it before relying on, publishing, or distributing it. Efata does not provide legal, financial, medical, or other professional advice.

Some results may use or refer to third-party material, including licensed stock photos. That material remains subject to its own license and conditions. Check those conditions before using it commercially or in a way that requires particular rights.

You may not use the Service to:

• break the law or violate another person’s privacy, publicity, or intellectual-property rights;
• upload material you do not have permission to use, or personal information you are not authorized to provide;
• create or distribute deceptive, threatening, abusive, or non-consensual content;
• send malware, spam, or content intended to disrupt or compromise the Service;
• scrape, reverse engineer, bypass access controls, or interfere with service limits or security; or
• use the Service in a way that harms other users or the operation of Efata.

You must not upload a minor’s personal information or image unless you have the necessary authority and permission to do so.

Features, usage limits, or paid offers may be described in the Service. If a fee applies, we will show the price and any billing, renewal, cancellation, or refund terms before you agree to the purchase. You are not responsible for a fee unless you accept the relevant offer.

Efata may update, suspend, or discontinue features. We do not promise uninterrupted availability or a specific uptime unless we separately agree to it in writing.

Efata and its licensors own the Service itself, including its software, visual interface, name, logos, and related materials. These Terms do not give you ownership of those materials. You may use the Service as provided by Efata, but may not copy, resell, or commercially exploit the Service except where the law allows or Efata gives written permission.

The Privacy Policy explains how Efata handles information and when prompts, files, or images may be sent to AI, hosting, or media providers. Third-party services are also subject to their own terms and policies. Efata is not responsible for services it does not operate.

You may stop using Efata at any time. To request account closure or deletion of associated personal information, email support@efata.design. Efata may restrict or suspend access if reasonably necessary to protect the Service, respond to legal requirements, or address a serious or repeated breach of these Terms.

When an account closes, saved work and related records will be handled under the retention and deletion practices described in the Privacy Policy. Some records may be retained where required or permitted by law or for security and backup purposes.

To the extent permitted by applicable law, the Service is provided “as is” and “as available.” Efata does not guarantee that every Output will be accurate, original, legally usable, or suitable for a particular purpose. You decide whether and how to use it.

To the extent permitted by law, Efata will not be liable for indirect, incidental, special, punitive, or consequential loss arising from your use of the Service. Nothing in these Terms excludes or limits a right or liability that cannot lawfully be excluded or limited.

We may revise these Terms as the Service or legal requirements change. We will post the current version here and update the “Last updated” date. Where required, we will give notice of material changes. Continued use after a change takes effect means you accept the revised Terms; if you do not agree, stop using the Service.

These Terms are governed by the laws of Nigeria. Subject to rights that cannot be limited by law, disputes will be handled by the courts with jurisdiction in Lagos State, Nigeria.
